Parent Service Terms
Welcome to register as a parent user of "FindTutor." Before registering or using the service, please carefully read the "Service Fee Explanation" and the terms below. These terms govern your use of the "FindTutor" website and its services. By completing the registration or starting to use the service, you agree to be bound by these terms.
"This website" refers to the "FindTutor" website and its affiliated platforms. The website reserves the right to revise the terms at any time, and the revised terms will be published on the website. The new terms will automatically take effect seven days after publication. Therefore, you should regularly check the "FindTutor" website for any changes to the terms. If you continue to use the website or related services after the terms have been changed, you will be deemed to have accepted the revised content.
Definitions
1.1 Definition of Terms
The following terms have the following definitions in these terms:
- "Case Confirmation/Acceptance of Case"
Refers to when the platform staff states "the case has been confirmed" via phone or WhatsApp. If the parent does not object within a reasonable time, the parent is deemed to have agreed and accepted the arrangement of the case.
- "All Subjects"
Refers to tutoring services that cover regular subjects for that grade level. For primary school, subjects include Chinese, English, Mathematics, and General Studies. For secondary school, subjects are based on individual school curriculums. Homework guidance is equivalent to all-subject tutoring.
- "Tutor/Parent/Tripartite Relationship"
Refers to a service cooperation relationship between the tutor and the parent, which is an independent cooperation agreement rather than an employment relationship. The relationship between the parent and the platform is merely a service user and service provider relationship. The platform is not an employment agency.
- "Membership Agreement"
Refers to any guidelines, instructions, terms, content, and descriptions on this website as part of the membership agreement. Successfully registering as a parent or using the platform means agreeing to all terms and content.
- "Parent Registration"
Refers to the parent's registration on the platform, which has the same legal effect as a physical contract.
- "Fraudulent Activity"
Refers to the parent or student misrepresenting personal information, providing false needs, or colluding with the tutor to engage in any improper behavior.
1.2 Headings
The headings in these terms are for convenience only and do not form part of the terms, nor do they affect the interpretation of the terms or any part thereof.
2. Provision of Services
2.1 Use
Anyone who wishes to use the website"s services as a parent or student can choose to register as a user of the website or log in as a "guest user."
2.2 Registering as a FindTutor Parent User
Parents need to provide all necessary information to FindTutor and complete the form on the website. By pressing the "Confirm" button, the registration is complete, and they become a parent user. FindTutor reserves the right to refuse any parent application without providing an explanation.
2.3 Right to Access, Correct, or Delete Personal Data
If you have any questions, opinions, or complaints about how we handle your personal data or wish to terminate the service, please contact us at +852 6392 7893. Additionally, you can modify, correct, or update personal data or request its deletion from our database as required.
2.4 Purpose of Collecting Personal Data
We will use the collected personal data and information for the following purposes:
(a) Registration and Identification:
(i) To process account registration and sign-up.
(b) Providing Services:
• To provide tutor matching services and allow you to participate in other activities on the website, including but not limited to contests, promotions, events, voting, and surveys.
(c) Administrative, Management, and Technical Support:
(i) For internal management and analysis.
(ii) To contact you, provide technical support, and handle complaints.
(iii) To detect and investigate any fraudulent or illegal activities and respond to relevant authorities when necessary.
2.5 Deleting Accounts
You can request to delete your personal account and terminate the relationship with the platform at any time without additional fees. Upon deleting the account, any pending service matching requests will be canceled. However, you are still obligated to fulfill any tutoring services related to FindTutor.
3. Parent Eligibility
Any individual over the age of 18 with full legal capacity, or any legally established entity, may register and use FindTutor"s services. FindTutor reserves the right to refuse any application for membership or to terminate membership without explanation. Those who do not meet the above criteria may not use the services.
4. Fees
4.1 Fee Explanation
The use of FindTutor"s services will incur relevant fees ("Fees"). Specific fees are detailed in the "Parent Fee Explanation" (hereinafter referred to as "Fee Explanation"), which is incorporated into these terms. FindTutor reserves the right to change fees at any time. Revised fees will automatically take effect seven days after publication on the website. All users should check the latest fee standards before using the service.
4.2 Payment Methods
(a) Parents must pay the relevant fees through bank transfer or other payment methods provided by FindTutor. (b) If the parent fails to pay the fee on time, FindTutor reserves the right to suspend the parent"s service eligibility and service provision until all due payments are settled. (c) Overdue payments will incur daily interest at a rate of 2% per month as compensation (not a penalty). (d) If the payment is overdue by more than 10 days, FindTutor has the right to impose a penalty of 20% on top of the outstanding amount and may transfer the case to a legal debt collection agency or lawyer for handling. The parent will bear all costs related to the debt, including legal fees, administrative fees, and collection agency fees.
4.3 Currency
All fees are calculated in Hong Kong dollars unless otherwise stated.
4.4 Other Charges
Parents are responsible for any applicable taxes and other costs incurred through the use of FindTutor"s services. FindTutor reserves the right to adjust, add, or remove any part of the service at any time.
5. FindTutor’s Responsibilities
5.1 FindTutor’s Responsibilities
FindTutor is an educational platform whose sole responsibility is to provide matching services between parents and tutors. The platform serves as an intermediary for service cooperation and does not participate in any employment relationship between parents and tutors. FindTutor has the right to collect relevant fees in accordance with the "Parent Service Terms". By using the platform, you agree to accept and comply with all terms and conditions.
5.2 No Guarantee on Tutor Compatibility
FindTutor explicitly states that it does not conduct detailed interviews with tutors and does not guarantee the tutor’s moral character, academic background, teaching quality, or the legality and suitability of the tutor’s services. It is the responsibility of the parent to assess the tutor"s suitability.
5.3 No Guarantee on Safety of Tutors or Parents
FindTutor is not responsible for the personal safety of parents or tutors or any losses incurred due to interactions between parents and tutors. The platform assumes no legal liability for any disputes that arise from such interactions.
5.4 No Guarantee on Service Continuity
FindTutor operates as a private tutoring intermediary service, providing tutoring on a session-by-session basis. FindTutor does not guarantee the continuity or stability of the service between parents and tutors. It is recommended that parents and tutors adopt a per-session payment model to avoid payment disputes caused by service termination or delay.
5.5 No Guarantee on User Data Accuracy
FindTutor is not a law enforcement agency and cannot verify the accuracy of the information provided by parents, students, or tutors. FindTutor is not responsible for any false information or misrepresentation by users. In the event of suspected fraud, parents can report it to law enforcement authorities, and FindTutor will cooperate fully.
5.6 Disclaimer for System Failure and Technical Issues
FindTutor assumes no responsibility for any damage or loss caused by system failure, technical issues, or service interruptions.
5.7 Limitation of Legal Liability
FindTutor is not liable for any disputes, claims, or damages arising from the interaction between parents and tutors.
6. FindTutor’s Rights
6.1 Right to Suspend or Terminate Membership
FindTutor reserves the right to suspend or terminate the membership of any parent who violates the terms or engages in illegal activities without any compensation.
6.2 Right to Handle User Data
FindTutor has the right to refuse or delete any data provided by parents without prior notice or compensation.
6.3 Right to Withdraw Service Conditions
FindTutor reserves the right to withdraw any service condition without prior notice or compensation.
6.4 Right to Refuse Service
FindTutor reserves the right to refuse service to any user without explanation.
6.5 Right to Change Fees
FindTutor reserves the right to change service fees at any time, with changes becoming effective seven days after publication.
6.6 Right to Modify Terms
FindTutor reserves the right to modify these terms at any time.
7. Terms of Tutoring Intermediary Services
7.1 Parent’s Basic Responsibilities
Once a case is confirmed, the parent must cooperate with the tutor and follow the agreed-upon tutoring schedule.
7.2 Responsibility to Provide Accurate Information
Parents must ensure that the information provided is accurate and truthful.
7.3 Responsibility for Canceling a Case
If the parent decides to cancel the tutoring case, they must not share the tutor"s personal information or contact details with third parties.
7.4 Responsibility for Fraudulent Activity
If a parent is found to have engaged in fraudulent activity, FindTutor has the right to terminate the service and seek legal action.
8. No Guarantee and Legal Accountability
8.1 Services Provided "As Is"
FindTutor provides services "as is" and makes no guarantees regarding service performance, quality, or accuracy.
8.2 Payment Mechanism Responsibility
FindTutor is not responsible for payment errors or failures caused by technical issues.
9. Fees
9.1 Fees
Fees are listed in the "Parent Fee Explanation" and are considered part of this agreement.
10. Additional Terms
10.1 User Conduct
Users must not interfere with the website’s operation or engage in illegal activities.
11. Parental Obligations
11.1 Verification of Tutor’s Qualifications
Parents have the right to request proof of the tutor’s qualifications.
12. Regular Legal Review
FindTutor commits to an annual legal review of these terms to ensure compliance with Hong Kong law.
13. Governing Law
These terms are governed by the laws of the Hong Kong Special Administrative Region.
